Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and JiMerhba. By creating an account or using our platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using JiMerhba, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users, including guests, hosts, and visitors.

You must be at least 18 years old to use JiMerhba. By using our platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Services & Eligibility

JiMerhba operates as a marketplace connecting guests with hosts for wedding experiences. We are not an event organizer or travel agency. You must be at least 18 years old and legally capable of entering into a binding contract.

🇲đŸ‡Ļ Moroccan Users: You confirm that you comply with the Moudawana (Moroccan Family Code) and do not facilitate illegal activities such as unregistered marriages.

3. Accounts & Verification

3.1 Account Registration

To use certain features of JiMerhba, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Accept all responsibility for activities that occur under your account.

3.2 Identity Verification

JiMerhba requires identity verification for both guests and hosts. You agree to:

  • Provide valid government-issued identification.
  • Submit accurate and authentic documents.
  • Understand that verification is mandatory to book or host weddings.
  • Accept that we may suspend or terminate accounts that fail verification.

4. Bookings, Payments, and Cancellations

4.1 Guest Bookings

When you book a wedding celebration as a guest:

  • Your booking is subject to host approval.
  • Hosts may accept, reject, or request additional information.
  • You agree to respect the host's cultural traditions and event rules.

4.2 Cancellation Policy

Guests may cancel their booking at any time before the event. Refund eligibility:

  • 7+ days before event: Full refund
  • 3-7 days before event: 50% refund
  • Less than 3 days: No refund

âš–ī¸ Moroccan Consumer Law 31-08: You have a 14-day cooling-off period for online services. Cancellations within this period entitle you to a full refund, regardless of the above policy.

4.3 Payments

Payments are processed securely through Stripe. Key terms:

  • Payments are held in escrow until 24 hours post-event.
  • JiMerhba charges a service fee (5-10%).
  • Hosts receive payment via Stripe Connect.
  • Currency conversions handled by Stripe.
  • VAT (20% in Morocco) and applicable taxes are collected per jurisdiction.

5. Host Terms & Responsibilities

5.1 Listing Accuracy

As a host, you agree to:

  • Provide accurate, truthful descriptions of your wedding celebration.
  • Upload authentic photos of your venue and event.
  • Clearly state all event details (date, time, location, capacity).
  • Honor all bookings you accept.

5.2 Guest Management

Hosts are responsible for:

  • Reviewing guest profiles and booking requests.
  • Ensuring guest safety and a welcoming environment.
  • Reporting any problems to JiMerhba.

6. Intellectual Property

All content on JiMerhba, including text, graphics, logos, images, and software, is owned by JiMerhba or its licensors and protected by copyright, trademark, and other intellectual property laws.

By uploading photos, videos, or other content to JiMerhba, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purpose of operating and promoting the platform.

You retain ownership of your content and may request its removal at any time.

7. Prohibited Conduct

You agree NOT to:

  • Use JiMerhba for any illegal or unauthorized purpose.
  • Violate any local, national, or international laws.
  • Harass, abuse, or harm other users.
  • Submit false or misleading information.
  • Engage in discriminatory practices (nationality, religion, etc.).
  • Upload malicious code, viruses, or harmful software.
  • Circumvent security features or authentication measures.

8. Disclaimers & Limitation of Liability

JiMerhba is a platform that connects guests and hosts. We do not organize, host, or attend events. The Services are provided "as is" and "as available" to the fullest extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JIMERHBA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY INJURY OR LOSS ARISING FROM INTERACTIONS WITH OTHER USERS OR ATTENDANCE AT EVENTS.

â„šī¸ Nothing in these Terms limits liability where prohibited by law, including under Moroccan Consumer Law 31-08 or EU Unfair Terms Directive.

9. Indemnification

You agree to indemnify and hold harmless JiMerhba from any claims, damages, or expenses arising from your violation of these Terms or your use of the platform.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Mandatory consumer protection laws of your country of residence remain applicable.

Any dispute arising under these Terms shall be resolved exclusively in the courts located in Morocco. For EU users, you may resolve disputes in your home courts in accordance with EU consumer protection regulations.

Before initiating formal proceedings, parties agree to attempt informal resolution by contacting JiMerhba support.

11. Force Majeure

JiMerhba shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or political instability.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms.
  • Fraudulent or illegal activity.
  • Failure to verify identity.
  • Abuse or harassment of other users.

13. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use constitutes acceptance of updated Terms.
